GENERAL TERMS AND CONDITIONS OF PURCHASE: ON-LINE PURCHASE PROCESS

Please read these General Purchasing Conditions before using the  www.mifarma.co.uk website, as well as the services offered by MIFARMA TIENDA ON-LINE S.L.

The use by the client of the services of the MIFARMA online shop presupposes, in any case, adherence to the General Purchasing Conditions in the version published by MIFARMA at the time of the purchase order.

It is therefore advisable for the customer to read these General Conditions before proceeding to make a purchase.

1. LEGAL INFORMATION AND ACCEPTANCE OF THE GENERAL PURCHASING CONDITIONS

1.1 Identification of the service provider

In compliance with Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, the identification details of the owner of the online shop accessible at  www.mifarma.co.uk  are:

1.2 Description

MIFARMA, through these General Conditions of Purchase, offers its users and visitors the possibility of making on-line purchases of pharmacy, parapharmacy, herbalist, optician, orthopaedic, cosmetic, beauty, hygiene and other products, as well as establishing communication with the user.

MIFARMA may alter at any time and without prior notice, the design, presentation and/or configuration of the www.mifarma.co.uk Website, as well as some or all of the services.

1.3 Acceptance of the particular conditions of purchase

Access to and use of the MIFARMA On-Line Shop service implies full and unreserved acceptance by the Visitor and/or Registered User of all the conditions set out in these General Conditions of Purchase.

These General Conditions of Purchase apply to the sale of all articles sold by MIFARMA through www.mifarma.co.uk , and are exclusively aimed at a public over 18 years of age.

MIFARMA reserves the right to cancel a customer's access account if fraudulent, speculative or bad faith acts are detected in the use of this service.

Likewise, MIFARMA reserves the unilateral right to modify these General Terms and Conditions of Purchase applicable to its On-Line Shop.

1.4 Limits to Purchases on www.mifarma.co.uk 

For security reasons, purchases of more than €2,000 cannot be made.



2. ON-LINE PURCHASING PROCESS

2.1 Our products, how to find them?

MIFARMA offers you a virtual shop that offers all kinds of pharmacy, beauty, health and parapharmacy products organised into families, so that it is easier for you to find them.

From the home page you can access all levels of product families through a button panel at the top, and on the inside pages, through a drop-down menu on the left-hand side.

You can also find products in MIFARMA through the search engine, where you only have to enter a key word (which can be the name of the product, characteristics or even incomplete words) and click on the search button.

All the products have a detailed file, which includes a photograph, the name, description and price including taxes. The images on the website are for guidance only and are provided by the manufacturer and may be subject to updates in the packaging and improvements in its formulation, you must take into account the product description which is what is sent.

All prices shown are final prices, expressly including Value Added Tax (VAT) at the time of purchase, notwithstanding that the user will have at all times detailed information on the price of the product.

You will also be informed of the different types of delivery and delivery times, which you can select according to your needs.

You can also express your opinion about each product, see the opinions of other users or even send it to a friend's email if you think it might be of interest to them.

The prices that appear on the product sheets are an invitation to the customer to make an order proposal; therefore, if there is an error in them, MIFARMA will inform the customer of this circumstance and will not process the order.


2.2 Shopping at MIFARMA

In order to shop at MIFARMA it is not necessary to register beforehand. All you have to do is select the products you want and, once you have finished, access the Shopping Cart and complete the purchase process/process the order.

Once the order has been completed, we will ask you for a series of data, including personal data, such as Contact Data, Delivery Address Data, Shipping Method, Payment Method, as well as expressly accepting these General Purchasing Conditions by ticking the corresponding box before processing your order.

Registering will facilitate your subsequent access to our website, your purchases and, as a registered Customer, you will be able to receive discounts, promotions and exclusive sales that we carry out, by e-mail, as well as not having to enter your details in the Contact form every time you buy from MIFARMA.

To register as a MIFARMA User, enter your details in the Contact Details Form and enable the functionality to create an account, entering an access password (with a minimum of eight characters).

Once the account has been created, we will send you an email to the email address provided confirming your registration as a user. Order confirmations will be sent to this address.

2.3 Availability of products

The selection of products offered through our online shop is valid as long as the products are visible, within the limits of available stock. As it is an e-commerce, the stock is updated online, so it could happen, eventually, that during the purchase process the stock runs out, not being able, therefore, in these cases, to continue with the purchase initiated.

In the event of any stock shortage or unavailability of an item, MIFARMA will contact the Customer to inform them as soon as possible and proceed to cancel the product or the entire order. In any case, a delay in delivery with respect to the deadlines indicated shall not entitle the Customer to claim any compensation whatsoever.

*Products on demand and childcare products such as cots, mattresses, high chairs, pushchairs, among others, may be delayed by more than 7 working days depending on the availability of stock in the factory.

 

2.4 How is the order processed?

When we click on the button process the order (after selecting the products and units), a secure connection is established through SSL, where you must enter a series of data in the following forms:

  • Contact details.

  • Delivery address details, if they are not the same as those you have provided in the Contact details.

  • Delivery method.

  • Payment method.

Then, you will have to finalise the order by clicking on the button to process the order and accept the general conditions of the purchase.

2.5 Transport and shipping costs

Shipping and/or handling costs are not included in the price and will be shown to the Customer before finalising their purchase, depending on the shipping address of each order and the transport provider that is randomly selected once the order has been received.

Regarding the shipping method you select, delivery times are established by the transport operators we work with. These delivery times are calculated on working days - Monday to Friday - as MIFARMA does not ship on public holidays, Saturdays or Sundays. 

The delivery times indicated are approximate and deliveries are made by the agencies throughout the day, and delivery times cannot be chosen.

 

The amount of the transport will be detailed before finalising the order.

MIFARMA cannot be held responsible for any delays in transport caused by:

  • Incorrect or incomplete address.

  • Failure to provide a contact telephone number.

  • Strikes by carriers.

  • Adverse weather conditions.

If the Customer does not notice any external breakage in the package when receiving it, but on opening it he/she observes any damage caused by the transport, or receives the order incomplete, he/she must notify the transport company within 24 hours to record this and notify MIFARMA via our Help Center indicating the incident.  Otherwise, it will be understood that the Product has been accepted in conformity.

The transport company and MIFARMA, once this period has passed (24 hours), will consider that the order sent is in perfect condition and will not be held responsible for any damage. We will not accept claims after this period.

* During the sales period, Black Friday or Christmas, the delivery time may be longer than usual.


2.6 What means of payment can I use?

Payment will be made at the end of the purchase process and will be an indispensable condition for the formalisation of the purchase. In any case, the choice of payment method is made during the purchase process on the corresponding screen.

We accept the following payment systems:

Payment by credit or debit card. Through the secure SSL connection, it is connected to Redsys, so that the bank details are transmitted directly and securely, so that MIFARMA does not have access to them or store them.

Payment via PayPal.

The Secure Electronic Commerce system is based on the card issuer (bank or savings bank) identifying the cardholder before authorising payment over the Internet. MIFARMA has a debit or credit card payment system with Redsys so that, once the product to be purchased has been selected and the card number has been entered, a verification window opens which communicates with the corresponding bank or payment card issuer, which will request identification.

The card details and password are protected by this security system from the moment they are entered. Once identification has been completed, the payment platform informs MIFARMA that the purchase is being made by the cardholder, so that he/she can complete the process. If the identification has not been satisfactory, the payment platform informs MIFARMA so that it can proceed accordingly.

Payment through Paypal. Paypal is the global leader in online payments and is basically a secure payment system in which the user opens an account in the system which subsequently allows him/her to make payments in a multitude of online shops around the world, using his/her credit or debit card. Paypal will be the only one that will have the Customer's bank details, being an intermediary between the Customer and MIFARMA.

This payment method is immediate, as soon as the Customer makes the payment, MIFARMA receives it and starts processing the order (after verifying that the details are correct).

The platform also includes payment via Stripe for some international countries.

Once the order has been processed, confirmation of the purchase is sent to the contact email address provided.

 

2.7 And if I have not made the purchase, what can I do?

If an undue or fraudulent charge is detected on the card used for purchases, you should immediately contact MIFARMA and the bank; contact us by email or telephone as soon as possible so that the appropriate steps can be taken. In addition, the Bank and/or the companies issuing means of payment may adopt anti-fraud measures that may lead to the rejection of certain types of transactions.

3. MIFARMA DISCOUNT VOUCHERS AND COUPONS

MIFARMA reserves the right to deliver gift vouchers and/or promotional or discount vouchers to users and visitors to www.mifarma.co.uk , as it deems appropriate, and to stop or withdraw them in the event that the user's behaviour is inappropriate or goes against the values of the company and/or its employees.

In order to make correct use of these coupons and discount vouchers, the code must be indicated and entered when the order is placed and applied by MIFARMA before payment is confirmed.

If it is not applied correctly, the customer must notify us as soon as possible, through our contact form for a solution, discounts are not applied to paid orders.

In order to apply a discount coupon it is necessary to be registered on the website and place the order with the user account logged in.

Gift vouchers or promotional vouchers may be limited to a single use, which will be specified in that case. Gift vouchers or promotional vouchers are not redeemable for cash.

Discounts are not compatible with each other, unless otherwise indicated.

MIFARMA may carry out specific promotions whose purpose is to regulate the allocation of gift vouchers to those users who make a specific purchase, for subsequent purchases in www.mifarma.co.uk  and within the period of validity of the same. Outside this period of validity, the gift voucher loses its effectiveness.

MIFARMA reserves the right to cancel or make changes to its promotions, as well as to the discounts offered.

4. RETURNS AND COMPLAINTS

4.1 Returns

The deadline for returns is 14 working days from the time of receipt of the order. Once the 14 days have passed, it will not be possible to process the return.

The Customer may return the entire order or part of it.

It is possible to request a return by clicking here and filling out he contactt form. We will send an email as soon as possible with instructions for the return.

The products must be in the same condition as they were received. They must keep their original seal intact. We will not accept the return of the product without the seal or if the product has been tampered with. If the quality control at the reception of the product detects that it has been opened or manipulated, the return will not be accepted and the customer will have to take charge of the collection of the product in our facilities. If the product received is not suitable for return, because it is not received in good condition or is a product not subject to return, the customer has a period of 10 calendar days to pick up the product at our facilities. After this period, MIFARMA reserves the right to discard the product.

When the returned product is received and the necessary checks are carried out, the credit will be made in the same account within a maximum period of 14 working days. The discounts applied at the time of purchase will be taken into account for the crediting.

According to current regulations (Royal Legislative Decree 1/2007, Revised Text of the General Law for the Defense of Consumers and Users) we do not accept returns of food products such as infant milk, baby food, food supplements, etc ... since the quality control of them is lost. For hygiene reasons, we do not accept returns of girdles, panties, bras, diaper cakes, glasses, mattresses, orthopedic products in general (wristbands, knee pads, gloves, etc...), sex toys, or any other intimate accessories or masks, among others.

* The return period may be extended at the discretion of MIFARMA in Christmas campaigns, Black Friday, etc ... Such changes, if any, will be published on the website of MIFARMA.

 4.2 Complaints

Once the order has been delivered, the customer must check that all the products are correct. The products as well as the packaging and the outer box must be kept until it is verified that there is no incident with the order.

If the Customer does not appreciate external breakages in the package at the moment of receiving it, but when opening it he/she observes damages due to the transport, or the lack of some product, he/she must notify it in less than 24 hours to MIFARMA providing evidence of the breakage (image, video, etc...), otherwise it will be understood that the order has been accepted in conformity.

The transport company and MIFARMA, once this period has passed, considers that the material sent is in perfect condition and is not responsible for any damage.

In case the product does not comply with the characteristics of the product sheet shown, except for the image, as we remind you that it is only a guide, on our web page or the product is defective from origin, the customer must contact MIFARMA through the help center within 48 hours after receiving the package. We will respond to the query with instructions to follow as soon as possible.

5. RIGHT OF WITHDRAWAL

In accordance with the Royal Legislative Decree 1/2007, Revised Text of the General Law for the Defense of Consumers and Users, MIFARMA recognizes the right of withdrawal of any purchase made in www.mifarma.co.uk  within 14 calendar days from the time the Customer received the product. Before any return you must contact the Customer Service Department through the Help Center:

In relation to the costs of withdrawal, this right can not involve any cost to the user, beyond that if the return is purely due to the right of withdrawal, and not a lack of conformity of the product, the user must bear the cost of the cost of returning the same (art. 108 of the Consolidated Text of the General Law for the Protection of Consumers and Users, TRLGDCU).

Therefore, the Customer shall bear the direct cost of returning the goods. In all cases, the products to be returned must be in perfect condition, in their original packaging and with the manuals, accessories or promotional gifts, if any, included. If this is not the case, the withdrawal cannot be exercised. The returns department will verify that everything is correct and in perfect condition, giving the authorization for reimbursement to the Administration Department and will communicate it to the Customer via email.

5.1 Products not subject to the right of withdrawal

In accordance with Article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the Revised Text of the General Law for the Defense of Consumers and Users and other complementary laws, it will not be possible to request the right of withdrawal in relation to: “The right of withdrawal shall not be applicable to contracts relating to:

  • (c) The supply of goods made to the specifications of the consumer and user or clearly personalized.

  • d) The supply of goods that may deteriorate or expire rapidly.

  • e) The supply of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and that have been unsealed after delivery”.

In accordance with current regulations, we do not accept returns of food products such as infant milk, baby food, food supplements, etc., since the quality control of these products is lost. For hygiene reasons, we do not accept returns of girdles, panties, bras, diaper cakes, glasses, mattresses, wristbands, knee pads, sex toys, or any other intimate accessories or masks, among others. As established in art. 12 of Royal Decree 870/2013, of November 8, which regulates the distance sale to the public, through websites, of medicines for human use not subject to medical prescription, you may not accept returns of medicines once they have been dispensed and delivered to the customer, except for those medicines that have been supplied in error, do not correspond to the order or have been damaged during transport.

6. PRODUCT WARRANTY

In accordance with Royal Legislative Decree 1/2007 of November 16, 2007, the warranty period for products is two years from delivery, although it does not include deficiencies caused by negligence, blows, incorrect use or improper handling, unsuitable voltage, incorrect installations, or materials that are worn out by use.This warranty is offered both by MIFARMA and by the manufacturers and, if applicable, authorized distributors of the product.Many of the products that are offered in www.atida.com, such as beauty products, aesthetics, parapharmacy, food products, have their corresponding expiration dates and preferential consumption, guaranteeing in any case that at the time of marketing the products have a sufficient period of time for their consumption.The guarantee offered by MIFARMA will be invalid under the following circumstances:Blows and/or inadequate transport.

Tampering with any seal or identification/control label.

Normal wear and tear.

8. CUSTOMER'S RESPONSIBILITY

The customer undertakes to make lawful use of the Services, without contravening current legislation or infringing the rights and interests of third parties.

The customer guarantees the truthfulness and accuracy of the data provided when filling in the contracting forms, avoiding causing damages to MIFARMA as a consequence of their incorrectness.

Likewise, the customer undertakes to enable the delivery of the requested order by providing a delivery address where the requested order can be received within the usual delivery timetable (Monday to Friday from 09:00 to 14:00 and from 16:00 to 19:00).

Failure to comply with any of these General Terms and Conditions may result in the cancellation or cancellation of orders by MIFARMA without prior notice to the customer and without any right to compensation.

In case the shipment is rejected by the customer, or due to any incidence derived from an incorrect or incomplete address, MIFARMA will not reimburse the amount of the shipping costs, being assumed by the customer.

9. INDUSTRIAL AND INTELLECTUAL PROPERTY

The intellectual and industrial property rights over the works, trademarks, logos, and any other subject of protection contained in the website correspond exclusively to MIFARMA TIENDA ON-LINE S.L., unless different ownership is indicated therein.

The unauthorized reproduction, distribution, commercialization or transformation of such works, brands, logos, etc. constitutes an infringement of the intellectual and industrial property rights of MIFARMA TIENDA ON-LINE S.L. or of the owner thereof, and may give rise to the exercise of any judicial or extrajudicial actions that may correspond to them in the exercise of their rights.

Likewise, the information to which the client may access through the website may be protected by industrial, intellectual or other property rights. The Company shall not be liable in any case and under any circumstances for any infringement of such rights that you may commit as a user and / or customer.

10. NOTIFICATIONS

All notices, requirements, requests and other communications to be made by the parties in connection with these General Conditions of Purchase must be in writing and shall be deemed to have been duly sent by ordinary mail to the address of the other party or its email address.

11. NULLITY AND INEFFICIENCY OF THE CLAUSES

If any clause included in these General Conditions of Purchase is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will only affect such provision or the part of it that is null or ineffective, subsisting the rest of the General Conditions of Purchase. Consequently, the clause declared totally or partially null or ineffective shall be deemed not to have been included.

12. APPLICABLE LAW AND SUBMISSION TO JURISDICTIONS

The sales and purchases made in www.mifarma.co.uk  are subject to Spanish law.

In case of any dispute that may arise from the interpretation of these general conditions of purchase and possible actions arising from the purchase procedure, the Courts and Tribunals that, where appropriate, will hear the matter, will be those provided by the applicable legal regulations on competent jurisdiction, in which, in the case of final consumers, the place of residence of the user or the place of performance of the obligation is taken into account, at their choice.
